These General Terms and Conditions of Sale (GTCS) govern the online sale of scooters and spare parts on the PROSPAD.COM website. Purchase implies unreserved acceptance of these General Terms and Conditions of Sale.
These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions, in particular those applicable to sales in stores or through other distribution and marketing channels.
These General Terms and Conditions of Sale (GTCS) define the terms and conditions for ordering, payment, delivery and management of any returns of Products ordered by the Customer.
The choice and purchase of a Product are the sole responsibility of the Customer. The images and graphics on the site are provided for illustrative purposes only. They have no contractual value and the Vendor cannot be held responsible for any differences between them and the Product delivered.
The essential information concerning the Products (technical specifications, illustrations, dimensions, capacity, etc.) is indicated on the website.
The Customer must take cognizance of this information before placing any order. The choice and purchase of a Product are the sole responsibility of the Customer.
The Customer must refer to the precise description of each Product to find out about its essential properties and characteristics.
Products are offered while stocks last. This information is specified when the order is placed. <\/p>

– Electric or non-electric scooters for city use.
– Electric or non-electric off-road scooters.
– Compatible accessories and spare parts.<\/p>

4. Controls<\/h2>

– The customer acknowledges having the required capacity to contract and acquire the Products offered on the Website.
Orders are placed exclusively via the Website.
An order confirmation is sent by email after validation and receipt of payment.
The seller reserves the right to cancel or refuse any order for legitimate reasons (stock shortage, pricing error, suspected fraud). In the event of unavailability of the product ordered, notably due to our suppliers, the customer will be informed as soon as possible and will have the option of cancelling the order or transforming it. In the event of order cancellation, we undertake to reimburse you as soon as possible. 7. Right of withdrawal<\/h2>

– The customer must check the general condition of the products at the time of collection. Any anomaly found (damaged product or product not conforming to the order) must be reported immediately to the staff on the spot. No claims will be accepted after the customer has left the premises without joint verification.

8. Warranties and returns<\/h2>

– Legal warranty of conformity:
– Scooter (excluding frame): 2 years from delivery.
– Battery: 1 year from delivery.
– The customer may request repair, replacement or reimbursement of the defective product.
– Specific warranty for the scooter frame: 5 years from delivery.
– For any defective product, the customer must contact the seller by email or telephone before returning it.<\/p>

9. Customs information<\/h2>

TC 4 RIDE SLU is located in the Principality of Andorra, a territory outside the European Union for customs purposes.
Any customer making a purchase on our site and wishing to leave Andorra with the products purchased may be subject to customs formalities and\/or import duties and taxes, in accordance with the legislation of the country of destination.
It is the customer’s responsibility to check with the relevant authorities beforehand to find out about any applicable duty-free allowances, as well as any declaration requirements on entering his or her country.
\u26a0\ufe0f Failure to comply with these obligations may result in penalties, including fines or confiscation of the goods by the customs authorities.
TC 4 RIDE SLU cannot be held responsible for the consequences of an incomplete, erroneous or missing declaration, nor for any costs, taxes or penalties incurred by the customer when crossing a border.

11. Scooter safety and compliance<\/h2>

– The customer agrees to comply with Andorran regulations governing the use of scooters.
– Checking local legislation: it is the purchaser’s responsibility to find out about and comply with the laws in force in the country where the products are to be used.
– We recommend that you take out specific liability insurance and wear helmets and gloves.<\/p>

12. Data protection<\/h2>

– The information collected is necessary to process orders.
– In accordance with Andorran legislation, the customer has the right to access, rectify and delete data.<\/p>

13. Changes to sales prices and terms and conditions<\/h2>

– TC 4 RIDE Slu is free to modify the sales prices at any time

The price and\/or the version of the GCS applicable is that in force on the website on the date the order is placed. In the absence of proof to the contrary, the data recorded in the Vendor’s computer system constitutes proof of all transactions concluded with the Customer. <\/p>
